The purchase deed follows Spanish law. The tax consequences reach you at home. Anyone who has the two advised separately ends up paying for the gap between them.

Property law

How a purchase works

Six steps, in this order

A purchase is built up in courses: each step carries the next. Skip one and it usually shows only when you come to resell.

  1. Initial consultation

    Buy personally or through a company? The decision comes before the first contract and sets the tax burden for the whole holding period and for the eventual sale.

  2. NIE number and power of attorney

    Nothing happens without a Spanish tax number. We prepare the powers of attorney used to apply for it and to complete the purchase without you being present.

  3. Checking the property

    Registry entry, encumbrances, debts, building permits, the cédula de habitabilidad. This is where it shows whether what was built matches what is registered — and what regularising it would cost.

  4. Preliminary contract

    The bilingual preliminary contract sets out price, payment schedule, deadlines and rights of withdrawal. You sign nothing you have not read in your own language.

  5. Signing before the notary

    Execution of the escritura pública and handover. We attend and translate what is actually being executed.

  6. Taxes and registration

    Transfer tax, plusvalía municipal, entry in the land registry, and transferring utilities and council property tax. Only then is the purchase complete.
